Terms of Service

These Terms of Service govern use of the Genesis Field Notes macOS application, related website, and associated support materials.

By downloading, installing, accessing, or using Genesis Field Notes, you agree to these Terms of Service. If you do not agree, the application and related services should not be used.

Use of the Software

Genesis Field Notes is provided as notebook software for writing, organizing, and connecting ideas. Subject to these Terms, the developer grants you a limited, non-exclusive, non-transferable, revocable right to use the application for lawful personal or professional purposes.

The application may be updated, modified, improved, suspended, or discontinued over time. Features may change, including optional AI-related functionality, compatibility, support materials, or system requirements.

Acceptable Use

You agree not to use Genesis Field Notes in any way that:

• Violates applicable law or regulation.
• Infringes or misappropriates the rights of others.
• Attempts to interfere with, damage, disable, reverse engineer, or misuse the application beyond rights permitted by applicable law.
• Uses optional AI functionality in a manner that violates the terms, policies, or usage restrictions of OpenAI or any other third-party provider used by you.
• Uses the software to create, store, or transmit unlawful, fraudulent, harassing, abusive, or malicious content.
• Attempts to use the application to compromise the security, integrity, or availability of devices, systems, or data.

If you supply an OpenAI API key for optional AI features, you are solely responsible for complying with OpenAI’s applicable terms, service terms, usage policies, and documentation.

User Content and Responsibility

You retain ownership of notebook content, notes, documents, prompts, exports, and other materials created, entered, or stored using Genesis Field Notes.

You are solely responsible for:

• The accuracy, completeness, and legality of notebook content.
• Reviewing, verifying, and evaluating any AI-generated output before relying on it.
• Any decisions, actions, or consequences arising from use of notes, exports, summaries, or AI-generated output.
• Maintaining backups and protecting access to devices, files, and credentials.

Genesis Field Notes is intended to support thinking and organization, not to guarantee correctness, professional advice, or error-free results.

API Keys and Third-Party Services

Genesis Field Notes may allow you to supply an OpenAI API key in order to access optional AI features. You are responsible for all activity associated with your own API credentials, including usage charges, account compliance, and security.

Use of third-party services through Genesis Field Notes is governed by the third party’s own terms, policies, and technical limitations.

The developer is not a party to the contract between you and OpenAI and is not responsible for the availability, accuracy, pricing, suspension, or performance of third-party services.

Intellectual Property

Genesis Field Notes, including its software, design, branding, interface, text, graphics, logos, documentation, and related materials, is owned by the developer or its licensors and is protected by applicable intellectual property laws.

Except for the limited right to use the software under these Terms, no ownership rights or other licenses are granted to you. You may not copy, distribute, sublicense, sell, lease, or create derivative works from Genesis Field Notes except as permitted by applicable law or express written permission.

No Warranties

Genesis Field Notes is provided as is and as available, with all faults and without warranties of any kind, whether express, implied, statutory, or otherwise, to the fullest extent permitted by law.

Without limiting the foregoing, the developer does not warrant that:

• The application will meet your requirements.
• The application will be uninterrupted, secure, or error-free.
• Data will never be lost, corrupted, delayed, or made unavailable.
• AI-generated output will be accurate, complete, reliable, or suitable for any particular purpose.
• Any future feature, update, or support service will be made available.

Limitation of Liability

To the fullest extent permitted by law, the developer will not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to Genesis Field Notes, including damages for lost data, lost profits, lost business opportunities, business interruption, device failure, corruption of files, misuse of the application, or reliance on notebook content or AI-generated output.

You assume all risk associated with use of the application, including the risk of data loss, output inaccuracy, or third-party service interruption.

If, notwithstanding the foregoing, liability is imposed on the developer, the developer’s total liability arising out of or relating to Genesis Field Notes will not exceed the greater of: (a) the amount paid by you for the application in the 12 months preceding the event giving rise to the claim, or (b) 50 U.S. dollars.

Some jurisdictions do not allow certain exclusions or limitations of damages, so parts of this section may not apply to the extent prohibited by applicable law.

Termination

These Terms remain in effect until terminated. You may stop using Genesis Field Notes at any time.

The developer may suspend or terminate access to any website, support resource, update channel, or related service, or may terminate your right to use Genesis Field Notes, if you violate these Terms, use the software unlawfully, or create risk or potential liability for the developer or others.

Upon termination, the sections that by their nature should survive termination will remain in effect, including sections on ownership, intellectual property, disclaimers, limitation of liability, governing law, and dispute-related provisions.

Updates to the Application and Terms

Genesis Field Notes may change over time. The developer may release updates, bug fixes, design changes, compatibility changes, feature additions, feature removals, or revised support materials.

These Terms may also be updated from time to time. Continued use of Genesis Field Notes after updated Terms become effective constitutes acceptance of the revised Terms.

Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.

Any dispute arising out of or relating to these Terms or Genesis Field Notes will be resolved in the state or federal courts located in Texas, and you consent to the personal jurisdiction and venue of those courts, except to the extent applicable law requires otherwise.
